새해 첫날 필리핀 특급호텔 욕조에서 승무원 한 명이 숨진 채 발견됐다. 5일(현지시간) 일간 선스타는 필리핀 북부 마카타시에서 승무원 사망 사건이 발생해 경찰이 수사 중이라고 보도했다. 부검에서 집단성폭행 흔적을 확인한 경찰은 총 11명을 강간 및 살인 혐의로 기소했다.

지난 1일 필리핀 북부 마카타시의 한 4성급 호텔에서 필리핀항공 소속 승무원 크리스틴 안젤리카 다세라(23)가 변사체로 발견됐다. 숨진 승무원을 최초로 발견한 남자 동료는 “새해 첫날 오전 10시쯤 일어나 보니 다세라가 욕조에 누워 있었다. 욕조에서 그대로 잠이 든 줄로만 알았다”고 진술했다. 담요를 덮어주고 다시 잠자리에 들었는데, 몇 시간이 지나도 다세라가 일어나지 않아 병원으로 옮겼다고 부연했다.

그러나 이송 당시 이미 체온이 많이 떨어진 상태였던 다세라는 병원 도착 직전 대동맥 파열로 사망했다.

 

부검 결과 다세라의 몸에서는 집단성폭행 흔적이 다수 발견됐다. 이를 토대로 수사를 벌인 경찰은 다세라가 호텔에 투숙했을 당시 현장에 있었던 남성 11명을 강간 및 살인 혐의로 기소했다. 경찰은 “차례로 잡아들인 11명 중 3명은 동료이며, 나머지는 다세라와 전혀 관계가 없는 낯선 인물들”이라고 밝혔다.

She was declared "dead on arrival" at around 12:25 p.m. (PHT) after she was rushed to a hospital. Initially reported as rape and homicide case, according to her death certificate, she died of aortic aneurysm or a rupture of the artery, but the Dacera family otherwise believed that Dacera was raped and her drink might have been spiked. In an ongoing investigation, eleven men who were with Dacera before her death have been tagged by authorities as "persons of interest".

한편 필리핀 관광부는 사건이 벌어진 호텔에 어떻게 손님을 받게 된 것인지 그 경위를 해명하라고 명령한 상태다. 해당 호텔은 코로나19 사태 속에 자가격리 및 무증상자 격리시설로 전환돼 개인 이용은 원칙적으로 불가했던 것으로 전해졌다.

The victim was drunk at the time of the incident.[10] At noon on January 1, Dacera's body was found in a bathtub in the check-in condominium. According to the police, several bruises were found on Christine's body and there was an indication that she was abused. In an autopsy, no signs of being choked or beaten on the head were found.[10]

The police initially reported her case as a "rape-slay"[11] but according to the autopsy report conducted by the doctor, Police Major Michael Nick Sarmiento, Dacera died from ruptured aortic aneurysm.[12] The police said that the cause of death could have been natural, however lacerations on her thighs, contusions on her knees, and scratches were found on Dacera's body. Lacerations and sperm were also found in her genitalia, indicating that there has been a sexual contact on her.[13] On January 5, 2021, following the identification of the suspects of the death of the flight attendant, the Philippine National Police (PNP) declared her death case "solved" despite lack of evidence and incomplete investigation at that point.[14][15] On the same day, Philippine National Police chief Gen. Debold Sinas threatened to hunt down the suspects of Dacera's death if they did not surrender themselves for three days.[16] No drugs have been found in the room rented by the group.[17]

On December 31, 2020 at 11:37 pm, Dacera had asked permission from her mother to have fun with her co-workers at the City Garden Grand Hotel in Makati. She was taken to Makati Medical Center on January 1, 2021 and was declared dead on arrival.[18] The said hotel was investigated if there was a violation of the quarantine protocol during COVID-19 pandemic, specifically regarding a provision that only two people are only allowed to check-in to a hotel room.[19] The Department of Tourism then revoked the hotel's permit to operate, suspended the hotel's accreditation for six months, and fined the hotel 10,000 on January 14.[20] A second autopsy was conducted on Dacera's body but the result remained confidential.[21]

On January 7, 2021, the PNP admitted that they have not secured the pieces of evidence regarding the death of the flight attendant.[22] On January 10, the National Bureau of Investigation (NBI) obtained bodily fluid from Dacera's remains in the second autopsy conducted on January 9 and it is yet to be subjected to a DNA test, which will be further strengthened as evidence to be used in the court case.[23] On the same day, the PNP said that they identified the eight participants in the room 2207, where Dacera had visited several times.[24]

Reactions and aftermath

On Monday, January 4, 2021, the hashtags #JusticeforChristinaDacera, #StopVictimBlaming and #ProtectDrunkGirls trended on Twitter.[12] Her death sparked online discussion for justice and condemnation of rape and victim blaming,[25] with some users also criticizing Dacera for the clothes she wore and alcoholism.[13] PAL Express expressed sympathy in a press release for the death of Dacera.[26] Human rights lawyer Chel Diokno said that the death penalty for the heinous crimes such as rape and murder is not the solution to the crime.[27] On January 5, the Department of Tourism (DOT) gave City Garden Grand Hotel three days to explain why their accreditation should not be revoked following the death of the flight attendant.[28] On the same day, flight attendant's mother Sharon Dacera sought another autopsy to dispute the initial findings of the police that Dacera died of natural causes.[29]

The news of her death was conveyed to the family of Dacera twelve hours after she died.[30] They added that they were not convinced that no rape had taken place. Since the police's statement does not match the medico-legal result, the National Bureau of Investigation (NBI) will conduct an autopsy on Dacera's corpse.[12] On January 6, Dacera's wake was first held privately in Pasay and later in Camp Crame, Quezon City.[31][32] Her remains aboard a Philippine Airlines Airbus A330 operating flight PR453, arrived in General Santos at 10:00 am on January 7.[21][33][34] She was then buried in General Santos on January 10.[4]

January 1, 2021

Dacera managed to call her family sometime past midnight, to inform them about the ongoing celebration at the Makati hotel, her mother Sharon revealed in an interview with reporters.

CCTV footage with timestamps showed Dacera briefly kissing a guy donning a cap, later identified as Valentine Rosales, before entering a room at 2.52am.

At 3.22am, Dacera can be seen interacting with another man in an adjacent room on the right side of the hallway, as two other men walk past them.

Three others from one end of the hallway were also seen a few metres away.

At 4.13am, Dacera can be seen being carried back by Dela Serna to the first room.

Rosales and Dela Serna, who both identify themselves as gay, later said in media interviews that Dacera was their friend and they would not do any harm to her.

Dela Serna and Rapinan also revealed in an interview with ANC they had to bring back Dacera from Room 2207 because she had already been vomiting early in the morning.

Meanwhile, Rosales and Galido pointed out Dacera would have already told them if she had been raped.

Galido said at around 10am he found Dacera in the bathtub of their room and thought she was sleeping. At around noon, after checking back to realise that Dacera was turning blue and appeared to be not breathing, he said he rushed to De Guzman and Dela Serna to seek help.

De Guzman and Dela Serna said they then asked for help from the hotel management and that they tried to revive Dacera with cardiopulmonary resuscitation, but failed.

The hotel advised them to rush her to the Makati Medical Center where she was declared dead on arrival reportedly due to ruptured aortic aneurysm.

The hospital reported the death to the Makati City police. Meanwhile, the other men from the adjacent hotel room were already gone by then.

January 2, 2021

An autopsy was performed on the body of Dacera at Rizal Funeral Homes in Pasay City at 9am, led by medico-legal officer Police Major Michael Nick Sarmiento.

Post-mortem findings on the incident, through a medico-legal report by the Southern Police District Crime Laboratory Office which eventually circulated on social media, indicated that the cause of death was “consistent” with what was previously reported as ruptured aortic aneurysm.

It also mentioned bruises on Dacera’s right hand, right thigh, knees, ankles, and right foot, and a linear abrasion on her right thigh. Deep healed lacerations and abrasions were also reported during the genital examination.

The document also noted that Dacera was already embalmed prior to the autopsy.

January 3, 2021

Authorities’ examination on Dacera’s body was completed at 1 pm, according to the medico-legal report.

Makati City Police, headed by Chief Colonel Harold Depositar, then reported details of the death to the media, two days after the incident.

January 4, 2021

The Philippine National Police sent the media a separate statement on the incident, saying they had already “solved” Dacera’s “rape-slay” case, despite some other missing details and conflicting reports on the matter.

PNP Chief Police General Debold Sinas said they had already arrested three of the men they tagged as suspects: Dela Serna, Galido, and Halili.

A rape with homicide complaint was filed during the inquest proceedings at the Makati City Prosecutor’s Office. Meanwhile, police are still tracking down the other suspects.

January 5, 2021

Dacera’s case has gained larger traction online with further developments coming from her family, the suspects, and authorities investigating the incident.

In an interview with CNN Philippines’ The Source, Depositar said traces of semen were also found in Dacera’s body. This was not previously indicated in the medico-legal report.

Depositar added that suspects may have used “force.” He also said that some of the suspects described themselves as gay.

The Tourism Department issued a show cause order to City Garden Grand Hotel for possible violation of COVID-19 protocols by admitting guests for leisure in a hotel designated as a quarantine facility.

Meanwhile, Dacera’s family revealed in a briefing they had sought another autopsy to dispute the initial findings of authorities that she died of natural causes. The family’s spokesperson, Brick Reyes, noted that the injuries on Dacera’s legs and arms as well as her remains would serve as enough evidence to establish a probable cause for rape.

But De Guzman, one of those involved in the hotel revelry who has come forward, denied what he called “absurd” speculations in various media interviews, claiming he is gay and has never had sexual intercourse with a woman.

Later in the day, Sinas gave the suspects 72 hours to surrender or authorities will “hunt them down.”

Dacera’s mother, Sharon, demands justice for her daughter’s death.

“I don’t want that somebody will be a victim by this kind of brutality, barbaric,” Sharon told the Philippine Daily Inquirer.

She had a blunt message for those responsible for the death of her daughter.

“You treated her like a pig,” she said.

“I don’t want this to happen to another woman who will be treated like that.

“Christine does not deserve this brutality.”

January 6, 2021

PNP spokesperson Brigadier General Ildebrandi Usana stressed that Dacera’s case could not yet be considered “closed” and they were still waiting for warrants of arrest for the suspects.

Reacting to the police order, De Guzman, along with his mother Claire dela Fuente told CNN Philippines they were advised by their lawyer to “stay put” and wait until they could file a counter affidavit.

They said that Sinas’ order was “without regularity.”

Justice Secretary Menardo Guevarra told the media in a statement that the forensic medicine team of the National Bureau of Investigation is already coordinating with the authorities to determine the true cause of Dacera’s death.

Later in the day, Dacera’s remains were brought to the PNP Headquarters in Camp Crame, Quezon City for a private funeral service, with only her family members and a few close friends allowed.

Meanwhile, the Makati City Prosecutor’s Office ordered the release of the three detained respondents in the case, citing the need for the police to submit the results of the DNA analysis, toxicology report, and histopath examination. A preliminary investigation on the others has yet to be conducted.

January 7, 2021

Dacera’s remains were flown to her hometown in General Santos City in the morning for a private funeral with family and friends.

Dr Marichi Ramos, a friend of the Dacera family, told reporters the body had been submitted to a second autopsy before it was sent home, but the findings would not be disclosed to the public.

Later in the day, Dela Serna, Rapinan, Galido and Rosales also reiterated their innocence and insisted that Dacera died of natural causes.

January 8, 2021

The National Capital Region Police Office announced that it has created a special investigation task group that will look into the case.

NCRPO chief Vicente Danao Jr also admitted that there was a “big possibility” the samples taken from Dacera may have been contaminated due to the embalming process that was done before the autopsy.

January 9, 2021 Dacera’s parents revealed that they had filed a complaint seeking the immediate relief of PMAJ Michael Nick Sarmiento for gross negligence and gross incompetence in the “irregular and inaccurate” preparation of Dacera’s medico-legal report and death certificate.
January 10, 2021

Dacera was laid to rest at the Forest Lake Memorial Park in General Santos City, more than a week after her death.

At this point, the NBI already has the identities of the Room 2207 occupants, but Justice Secretary Menardo Guevarra said he would not reveal the names until they are summoned.

January 11, 2021

Guevarra announced the results of the forensic examination of Dacera’s body would soon be released. Eight of the 11 respondents to the case were also represented by their lawyers to explain their side to authorities.

NBI Deputy Director Ferdinand Lavin also said they had found “encouraging leads” and “pieces of evidence” that would prove whether there were lapses in the first autopsy conducted.

He added that so far, there are “good indications” that a crime was committed. He also requested that other suspects who have not yet surfaced to cooperate with them.

January 12, 2021

In a press briefing, Lavin disclosed that apart from rooms 2207 and 2209, they had also looked into room 2009 of the hotel for potential evidence linked to Dacera’s death.

He also stressed the bodily fluids retrieved from the second autopsy had been forwarded to the Death Investigation Division, which will be the one to provide further details after a final assessment and consolidation of all the findings of their forensics team.

Later in the day, Guevarra revealed that about 100ml of urine were extracted from Dacera’s body, which would further aid the investigation.

Results of the laboratory examination may come out in a few days, he added.
